The fast-track court found the accused guilty of rape and criminal intimidation

A 38-year-old man has been sentenced to life imprisonment for raping his 60-year-old mother in Uttar Pradesh's Buland city. The man raped his mother on January 16 last year, after which her brother reported the matter to the police. A fast-track court found him guilty and delivered its verdict on Monday.

“This rape case was registered about a year and a half ago. A woman accused her son of rape. Police registered an FIR under relevant provisions. The accused's brother was the complainant. Fast Track The court sentenced the culprit to life imprisonment and a fine of Rs 51,000.

Public prosecutor Vijay Kumar Sharma said that he had never faced such a case in his career. “The mother kept crying and repeating, 'My son raped me'. The man took her mother to fetch fodder from the field and raped her.”

The woman said in her statement that her son took her to the farm, strangled her, raped her and pressured her to perform sexual acts regularly. “I begged him with folded hands, but he abused me. I kept saying that I am an old woman. I lost consciousness. When I came back, he threatened me if I did anything about the incident. He would kill me if I told anyone about it. I somehow came home to sleep with him every night and told my niece and son (complainant),” she said, according to the court order. The woman's husband died 10 years ago.

The doctor who examined the woman said that there was no sign of external or internal injury on her body. Citing an earlier decision, the court noted that even if the doctor who examined the victim did not find any signs of rape, that was not a ground to reject the complainant's testimony.

The court also noted an earlier decision of the Supreme Court: “If a rape victim states under oath that she was forced to have sex, her statement will generally be accepted, even if uncorroborated, unless the material on record requires a drawing to infer that there was consent or that the whole incident was improbable or fictitious.”

The accused had told the police that he had not committed the crime and that he was innocent. He said that the case against him is false and has been registered to usurp his property.

The court order said that the defense did not present any witness to prove the property dispute between the accused and his mother. “It should be clear that no mother will accuse her son of raping her just to get property,” the court order said.

Apart from rape, the court also found the man guilty of criminal intimidation, for which he was sentenced to one year in prison and a fine of Rs. The court said that the two jail sentences will run concurrently.
