Bombay High Court allows virtual hearing on all benches after CJI DY Chandrachud’s reprimand


Following the rap of Chief Justice of India DY Chandrachud, the Bombay High Court has opened virtual hearings for all its benches with immediate effect.

“All stakeholders are hereby informed that every court of the Bombay High Court including its Benches can now be virtually accessed by the stakeholders, unless otherwise, in cases listed before the Courts, attendance or not be directed to participate. in the hearing virtually through the facility of hybrid video conferencing,” said a notice issued by Registrar (Judicial) SM Bhosle.

The notice further states that all virtual hearings can be accessed through the official website.

The Supreme Court on Friday (06.10.2023) directed all High Courts to ensure that no member of the bar is deprived of hearing through access to video conferencing facilities or hybrid facility. The Supreme Court had given two weeks time to all High Courts to comply with its order.

“After the expiry of two weeks from this order, no High Court shall deny any member of the Bar access to hearing through video conference facility or hybrid facility.” The court ordered.

A bench of Chief Justice DY Chandrachud, Justice JB Pardiwala and Justice Manoj Mishra also issued several additional directions regarding video conferencing facilities in High Courts and Tribunals.

During the hearing, CJI DY Chandra Chowdhury expressed his dismay at the scrapping of video conferencing infrastructure in the Bombay High Court. “Why was the Bombay High Court demolished? In a city like Bombay, even commuting is so difficult. Technology is not a matter of choice. Technology is as much a part of our legal system as the law books. Without technology, how can we function?” Will you?” They said.

The Supreme Court noted that apart from Justice GS Patel and a few others, no one was using the hybrid hearing facility.
