“The Court is well aware of the fact that the conduct of the accused in this case before his arrest and during the trial, even during judicial custody, has been brutal. However, it is a fact that he is in judicial custody from 03.04.2020,” the court said.
He added: “The court is also aware of the fact that the accused Shahrukh Pathan is also involved in another riot case FIR No. 51/2020 PS-Jafarabad where he has claimed to have attacked the life of a policeman, however, said that the case It should deal with its own facts.
Pathan was denied bail by a judge in December 2021 after CCTV footage from a nearby camera in the area showed his presence in the rioting crowd.

After that, he applied for regular bail in the Delhi High Court last year. In the said FIR against Pathan in December 2021, the court had issued sections 147 (rioting), 148 (rioting armed with weapons), 149 (unlawful assembly), 186 (obstructing public servants from performing public duties), 188 (Disobedience) charges were framed. order duly issued by public servant), 153A (promoting enmity between different groups on grounds of religion etc.), 283 (endangering or obstructing public way or line of navigation), 353 (obstructing public servant assault or criminal force for) Indian Penal Code Sections 332 (voluntarily causing pain to a public servant to prevent him from performing his duty), 323 (voluntarily causing pain) and 307 (attempt to murder).
The FIR was registered under Section 27 of the Arms Act along with Sections 147, 148, 149, 186, 188, 153A, 283, 353, 332, 323, 307, 505, 120B and 34 of the IPC.
Rohit Shukla, the injured person, had stated that on February 24 last year, there were two groups of people, one of which was chanting “Allahu Akbar” and protesting against CAA and NRC. He also said that the illegal gathering turned violent and started pelting stones and one person pulled a pistol on him.
He also stated that at another point, a 24-25-year-old boy from the violent crowd came with a pistol and tried to kill him. According to the statement, it was alleged that the boy fired at the witness after which he was injured.
