Arvind Kejriwal, ED and Delhi High Court
The Delhi High Court on Friday stayed Aam Aadmi Party (AAP) leader Arvind Kejriwal's release on bail after the Enforcement Directorate (ED) challenged the trial court's bail order in a money laundering case linked to the Delhi Excise Policy. Approached the court.
The petition was mentioned before a vacation bench of judges. Sudhir Kumar Jain And Ravinder Dodija Additional Solicitor General (ASG) SV Raju on behalf of ED.
“I am going for immediate stay. The order was pronounced at 8 pm yesterday. The order was not uploaded. We were not given a clear opportunity to oppose the bail”. They said.
Appropriately, the ASG cited the Bar and Bench report and argued that he was not given adequate opportunity by the trial court to oppose the bail application.
“It is on the bar and the bench that they belittled my arguments. My plea for a stay on the bail order was also not considered. I am demanding that the injunction be stayed and the matter be heard at the earliest.” We have been denied the opportunity to discuss the case in all seriousness. ASG said.
Senior advocate Abhishek Manu Singhvi, appearing for Kejriwal, opposed the stay plea.
“There are ten decisions of the Supreme Court that cancellation of bail is fundamentally different from grant of bail.” They said.
After hearing the counsel, the High Court directed that the bail order should not be implemented till the court hears the matter.
“The bail order will not be granted. We have not passed the final order. You can argue as much as you can.” The court said that the release of Kejriwal should be stopped.
The matter was then adjourned for hearing today.
The trial court had granted bail to Kejriwal on Thursday.
A vacation judge Naye bandu Kejriwal was ordered to be released on a surety bond of Rs.
The ED had asked the court to stay Kejriwal's release for 48 hours, but the judge rejected the request.
Kejriwal was arrested by the ED on March 21 on charges that he was part of a conspiracy to deliberately leave loopholes in the now-defunct Delhi Excise Policy for 2021-22 to benefit certain liquor sellers.
The ED has alleged that kickbacks from liquor sellers were used to fund the Aam Aadmi Party's (AAP) election campaign in Goa and that Kejriwal, being the party's national convenor, was involved in money laundering. are personally liable for the crime.
Kejriwal has denied the allegations and accused the ED of running an extortion racket.
Other AAP leaders arrested in the same case include former Delhi Deputy Chief Minister Manish Sisodia and Member of Parliament Sanjay Singh.
Singh is currently out on bail while Sisodia is in jail.
The Supreme Court had granted interim bail to Kejriwal in May to allow him to campaign for the Lok Sabha elections. He returned to jail on June 2 after the interim bail granted by the Supreme Court expired.
He also filed a seven-day interim bail application on medical grounds. However, it was rejected by the trial court on June 5.
Thereafter, his regular bail application on merit was allowed by the trial court and directed the ED to approach the High Court.
