Emergency undemocratic, but strictly within constitutional limits: Shashi Tharoor says 'government attempt to remove…

Congress leader Shashi Tharoor slammed the Prime Minister Narendra Modi-led government at the Center for using Emergency as a tactic to 'distract' it from real issues like NEET paper leaks, Manipur situation and unemployment. . Tharoor, the fourth-term Congress Member of Parliament (MP) from Thiruvananthapuram asked why it was relevant to 'dredging' something that happened 49 years ago.

The former Union minister also said that while the imposition of Emergency by then Prime Minister Indira Gandhi in 1975 may have been 'undemocratic', it was strictly 'within the bounds of the Constitution.'

“I am a critic of the Emergency… but the fact is that the Emergency was undemocratic, but it was not unconstitutional. It was a clause in the constitution that allowed for internal emergency. That clause has since been removed. Ever since but it was there then,” Tharoor told NDTV in an interview.

Tharoor was referring to a resolution read by newly elected Speaker Om Birla in the Lok Sabha on Wednesday condemning the imposition of Emergency in 1975. Which criticized the opposition Congress.

President Draupadi Murmu in her address to Parliament on Thursday termed the Emergency as “the biggest and darkest chapter of a direct attack on the Constitution”, which also raised the ruckus of the Congress party. Tharoor termed the emergency as 'unconstitutional'. Not legally correct.

Everything the government did in 1975 was within the bounds of the Constitution. So for the Rashtrapati to say it was an unconstitutional attack or an attack on the Constitution is actually legally wrong,” Tharoor said, adding that the Constitution was not suspended during those months.

“I'm not saying it's something to be proud of… but I'm just challenging the claim that it was unconstitutional. It wasn't. It was completely within the Constitution, however unwelcome…” The Congress leader said.
