Father files FIR against Anand Mahindra after son dies in Scorpio SUV accident

An FIR has been registered against Mahindra Group Chairman Anand Mahindra and 12 others in Kanpur following a complaint by a resident of the city. The complaint alleges that “false assurances” regarding the safety of the Mahindra Scorpio SUV led to the death of the complainant’s son.

The case was registered when Rajesh Mishra, who tragically lost his son Dr Apoorva Mishra in an accident on January 14, 2022, approached a local court, which ordered the registration of an FIR. Car dealership manager Anand Gopal Mahindra is also among those booked at Raipurwa police station in Kanpur.

Mishra’s complaint states that he purchased a black Mahindra Scorpio SUV for Rs 17.39 lakh on December 2, 2020. He himself made this purchase after seeing the advertisements and social media posts of Anand Mahindra. Mishra claimed that he purchased the vehicle keeping the safety claims in mind and later gifted it to his only son.

On that fateful day, January 14, 2022, Dr. Apoorva Mishra was returning from Lucknow to Kanpur in a car with his friends, and all of them were wearing their seat belts, as per the police report. Due to fog, the car collided with the divider and overturned several times and sadly Dr. Apoorva lost his life on the spot.

The complaint asserts that Mishra would not have purchased the car had the dealership and the company’s advertisements not provided assurances. It is further alleged that the airbags of the car did not deploy despite wearing seat belts, resulting in the untimely death of Dr. Apoorva. Mishra argues that the company cheated him by giving false assurances and claims that he later learned that there was no airbag in the car.

The FIR has been registered under various sections of the Indian Penal Code, including cheating, negligent conduct in relation to machinery, causing death by negligence, intentional insult with intent to provoke breach of peace, criminal intimidation and criminal intimidation with threat of hurt. Investigation into the case has begun, with Raipurwa SHO Aman Singh confirming that further action will be taken based on the findings. Singh said, “The case was registered following the court order. We have started investigating the matter and will share more information soon.”
