Illegal construction: HC orders resale of illegally constructed flats in Gurgaon


After the High Court's notice on the illegal flats, the town planner again sealed the building.

Gurgaon: The Town and Country Planning (Enforcement) Department on Monday sealed a building in C-2 block of Palam Vihar after it was illegally de-sealed by the owner.
The building located at House No. 913 was sealed earlier due to unauthorized construction but the owner illegally broke the seal and started the activities again.
Acting quickly, the department resealed the property and stepped up its surveillance efforts.
District Town Planner Manish Yadav, spearheading the enforcement, sent a formal letter to the Deputy Commissioner of Police, asking the local authorities to ensure that house no. 913 and house no. 1310 on the other property. Keep the seals intact.
Both properties were sealed in June 2024 for violating building regulations but the owners illegally de-sealed them.
Despite a resealing operation on September 9, the owners tampered with the seal once again, prompting the department to take further action.
Currently, the hearing of this case is going on. Punjab and Haryana High CourtWho has taken a strict stance on unauthorized constructions in the area. The High Court's intervention came after the local Resident Welfare Association (RWA) filed a petition against the illegal construction. 16 Flats in 11 Buildings in C-2 Block, Palam Vihar, Haryana. The petition highlights how several buildings in the block have been encroached upon. Haryana Building Code Regulations, four-storied structures are being constructed on residential plots, each floor consisting of four flats.
A double bench of Justices Arun Pally and Vikram Aggarwal has issued a notice to the Haryana government and ordered to stop further construction. The court's strict directions have intensified the check on illegal constructions in the area, with DTPE's enforcement activities playing an important role.
Apart from re-sealing the de-sealed properties, DTPE also carried out a large-scale demolition and sealing drive in the Palam Vihar Vyapar Kendra market. Illegal constructions in common areas were dismantled and unauthorized businesses, including a liquor store and a gym operating in restricted areas, were sealed.
The High Court's notice and continued enforcement actions by DTPE are seen as part of a larger crackdown on unauthorized development in Gurgaon. Local RWAs have expressed strong reservations and the court has warned that further illegal constructions will have serious legal consequences.
As the case continues, the court has asked the authorities concerned for their response till the next hearing on October 28.
Last week, the High Court had sought a reply from the state government on construction of additional flats and floors in residential buildings in Palam Vihar's C-2 block in violation of Haryana Building Code regulations, following a plea by a local RWA.
The petition, filed jointly by a local resident Ravi Bharadwaj and 15 others, has claimed 11 buildings of C-2 Colony — 979B, 921, 922, 924, 935, 913, 951, 956, 1251, 1226, and 1310. — was flagged. Where there were four storey buildings with stilt parking and four flats on each floor.
