Marvel Rivals' TOS includes a “non-abusive” section to prevent players from leaving “negative reviews”

Update 6pm: NetEase has apologized for “unfair and misleading terms” in its content creator contracts.

In a statement posted to Discord shortly after the contract made headlines, Marvel Rivals' content creator team said it “sincerely apologizes” for the “miscommunication and your unpleasant experiences.”

“We are aware that the commitment contains unfair and misleading terms regarding sharing of non-offending content,” the full statement said. “We sincerely apologize [sic] For misunderstandings and your unpleasant experiences!

“We are absolutely open to both suggestions and criticism to improve our game. And we [sic] Our mission is to better satisfy Marvel Rivals players with those creative suggestions.

At the time of writing, it is unclear whether previously signed contracts are now void and invalid, but NetEase says that “all terms will apply only when both parties have discussed and agreed to the terms”.

In a statement to the press, NetEase said: “The contract is a draft version that aims to create a long-term collaboration with creators interested in Marvel Rivals. The development team hopes to receive more meaningful and frequent feedback, suggestions and criticism more thoroughly. Through cooperation.”

The basic story is as follows.

Original story, 1.50pm BST: Players and content creators have hit back at Marvel Rivals for the terms of the Playtest service contract that prevent players from making “statements harmful to the reputation of the game”.

In section 2.1 of the agreement – ​​subtitled “Non-disparagement” – content creators are obliged to agree “not to make any public statements or engage in discussions that are harmful to the reputation of the game”.

This “includes, but is not limited to”, “making derogatory or sarcastic comments about any game-related content, such as game features, characters, or music”, and “engaging in malicious comparisons with competitors.” Containing or minimizing differences in gameplay or Marvel's “opponent or providing a subjective negative review of the game”.

Interestingly, the FAQ published in the game's Discord community states that “There is no NDA for our Closed Alpha test” and allows players to “share your experiences and all types of content across all platforms. is encouraged”.

Some players have also shared concerns about the terms of service on the official Discord server, but as of now, there has been no response to their queries.

Others on Twitter/X claim that the developers have agreed to “amend” the contract, but it appears they haven't done so yet.
