A Delhi court on Friday said that AAP MP Raghu Chadha cannot claim that even after the cancellation of allotment, he has full right to continue occupying the government accommodation during his rule. The court was hearing a case between the MP and the Rajya Sabha Secretariat regarding the allotment of his Type VII bungalow.
The Rajya Sabha Secretariat had canceled the MP’s allotment of a Type-VII bungalow in Delhi’s Pandara Road in March. He was told that the allotment had been canceled as Type VII exceeded his entitlement as a first-time MP and he was allotted another flat.
later on, Raghav Chadha approached Delhi’s Patiala House Courts. Against the RS Secretariat and obtained an injunction against disposal in April.
The Rajya Sabha Secretariat then filed a petition opposing Chadha’s plea and argued that the court could not have issued the order without hearing the Secretariat.
On Friday, a Delhi court vacated its order restraining the Rajya Sabha secretariat from removing an AAP MLA from his official residence. It said that the allotment of the government bungalow was only a privilege and Raghav Chadha had no right to continue to occupy the building even after the allotment was cancelled.
Raghav Chadha was allotted a Type VI bungalow in July 2022. In August 2022, he approached the Chairman of the Rajya Sabha for the allotment of Type VII accommodation. He was then allotted a type VII accommodation bungalow on Pandara Road, Delhi.
According to the Rajya Sabha Members’ Handbook, first-time MLA Chadha is entitled to Type-V accommodation. MPs who are former Union Cabinet Ministers, former Governors or former Chief Ministers and former Speakers of Lok Sabha are entitled to Type VII bungalows.
