The man who pulled a gun on the police during the CAA protests in Delhi got bail.

A Kakkadoma court on Saturday granted bail to Shah Rukh Pathan, who took part in anti-citizenship law protests here in 2020 after a viral photo showing him pointing a gun at a policeman. It led to his arrest.

He was accused of injuring several policemen and injuring one Rohit Shukla during clashes that broke out amid protests over the Citizenship (Amendment) Act here in February 2020.

Mr. Pathan will remain in jail as he is also accused in another case in which he is said to have assaulted a policeman.

The bail was granted by Additional Sessions Judge (ASJ) Amitabh Rawat, who observed that the court was aware of the fact that the conduct of the accused before arrest and even during trial and judicial custody had been brutal, but it pronounced the judgment as it has been. In judicial custody from 03 April 2020.

At the stage of prosecution evidence, where the public witness/injured Rohit Shukla has been examined and the other relevant witnesses are all police personnel and all other co-accused are on bail, the current bail application of accused Shah Rukh Pathan is allowed. The court said.

Counsel for the accused submitted to the court that Mr. Shukla’s statement/allegations do not affect credibility as there are inconsistencies in his statements on different dates and his statement has improved in the court. It was further argued that police witnesses are made witnesses.

The public prosecutor vehemently opposed the bail and cited evidence against the accused such as CCTV footage, mobile location and witness statements. The public prosecutor also told the court that the accused’s father had also served a prison sentence for possession of prohibited articles. Marijuana And his family has a history of criminal cases.
