Officials of the right-wing organization Hindu Manni have filed three writ petitions before the Madras High Court objecting to Tamil Nadu minister Adhyayandhi Stalin’s remarks about Sanatan Dharma.
He has sought clarifications from Stalin, minister PK Sekar Babu and MLA A Raja, seeking to issue quo warranto under what authority they held public positions, “despite attending a conference in which Its abolition was demanded. Sanatanadharma.”
Justice on Friday Anita Samantha Directed the petitioners to produce documents in support of their claim that the Ministers and MPs have violated the provisions of Article 51A (c) (e) of the Constitution which protect the sovereignty, unity and integrity of India. It imposes a duty on every individual to maintain and protect it. and to promote the spirit of harmony and brotherhood among all people.
On September 2 this year, at a conference organized by the Tamil Nadu Progressive Writers Artists Association in Chennai, Adhyayanidhi Stalin had said that certain things should not just be opposed but eliminated.
“Just as dengue, mosquito, malaria or corona virus need to be eradicated, we need to eradicate Sanatan.” He said, causing widespread outrage.
Senior advocate P Wilson, appearing for Stalin on Friday, told the court that the petitioners have not produced any evidence to support their claims.
He said that the prayer of quo warranto is sustained only if the petitioner proves that there has been a violation of appointment to public office or any disqualification under the Constitution or laws. In this case, no such disqualification is attracted. He said that having a political point of view cannot be a disqualification.
The court then asked the petitioners to submit the necessary documents.
The High Court will hear the matter further on October 11.
A plea for registration of a First Information Report (FIR) against him is already pending in the Supreme Court on his remarks.
A Jammu and Kashmir court also recently ordered an inquiry into a lawyer’s plea to file an FIR against Stalin.
