Walmart to face lawsuit that claims they measure prices at the register


Walmart is set to face a class action lawsuit that says the retailer overcharged customers through “deceptive and unfair pricing practices.”

Plaintiff Yoram Cahan alleged that the world's largest retailer “takes advantage of consumers in Illinois and across the nation through deceptive and unfair pricing practices.”

Kahn argued that although the price discrepancies were small, they “add up to hundreds of millions of dollars per year.”

“Kahn alleges that Walmart is aware of these discrepancies between shelf prices and register prices and that its unfair and deceptive pricing practices are pervasive and continuing,” he said.

Khan alleged that he made a purchase at a Walmart store in Niles, Illinois, on August 2, 2022, and relied on the marked prices but ended up paying a significantly higher price when he checked out.

“The actual prices of these six items when Khan checked out were between ten and fifteen per cent higher than the shelf prices,” the court ruled.

“In total, Kahan paid Walmart an extra $1.89 on these six items, which amounts to about seven percent of the pre-tax total of his bill,” he said. “Of course, that's small change for Kahan as an individual, but consider the volume of Walmart's business.”

Reversing a lower court judge's ruling on Wednesday, the Chicago-based 7th U.S. Circuit Court of Appeals ruled that consumers can try to prove that Walmart used a deceptive “bait-and-switch” method that violates state consumer protection laws.

The plaintiffs alleged that Walmart violated the Illinois Consumer Fraud and Deceptive Trade Practices Act, the Illinois Uniform Deceptive Trade Practices Act, and other states' consumer protection laws.

The Court also disagreed with Walmart's argument that providing a receipt after a purchase negated any unfairness caused by inaccurate shelf prices.

Walmart, based in Bentonville, Arkansas, did not immediately respond to Fox News Digital's request for comment.
